Why there's no cap — and what limits fees instead

Michigan has no statute capping residential late fees. The Truth in Renting Act's list of prohibited lease provisions (MCL 554.633) does not mention late fees, and the security-deposit act regulates deposits only. What protects tenants is the common-law rule against penalties: a late fee must be a reasonable estimate of the landlord's actual damages, and courts may refuse to enforce an excessive fee. There is no fixed statutory percentage — treat any "acceptable percent" figure you read online as folklore.
