The cap
Under 25 Del. C. § 5501(d), Where the rental agreement provides for a late charge, Delaware caps it at 5% of the monthly rent. The statute also treats a late charge as additional rent for purposes of the code.
When the fee can start
A late charge may not be imposed within five days of the agreed rent due date. The landlord must also maintain an office or other permanent place in the rental unit's county where rent can be paid on time — if they don't, the due date itself extends by three days, effectively giving tenants eight days. The statute applies "where the rental agreement provides for a late charge" — if the agreement doesn't provide for one, there is no basis to charge it.

The late-fee statute carries no specific penalty, but a tenant can sue to recover an illegal charge under the code's general cause of action (25 Del. C. § 5117). Note that lease clauses awarding attorney's fees are unenforceable in Delaware rentals (§ 5111).
