Montana landlord entry laws

How much notice your landlord owes you before coming in, when they may enter without it, and what Montana law lets you do about it.

Notice required

24 hours

At least 24 hours' notice of the intent to enter, entry only at reasonable times, and the landlord may not abuse the right of access or use it to harass the tenant.

When they may enter without notice

Entry without consent is allowed in an emergency.

What you can do about a violation

Injunctive relief to prevent it recurring, or termination of the rental agreement — and in either case actual damages.

Worth knowing: Montana sets no minimum and does not shift attorney fees.
